Understanding Worker Misclassification
Worker misclassification occurs when an employer incorrectly labels employees as independent contractors. This is problematic because misclassified workers often do not receive the workplace protections to which properly classified employees are entitled under the law.
To determine whether a worker is an employee or an independent contractor, employers should consider and weigh the factors required by law, including but not limited to, who controls how the work is done, who controls the location where the work is performed, who provides the materials and tools needed for the work, and the payment method.

The tax forms that an employer requires a worker to complete or provide do not influence or determine the proper classification of a worker as an independent contractor.
Certain occupations, including construction, barbers, bookkeepers, babysitters, musicians, and models, have specific factors or requirements for workers' compensation.
Best Practices
Review the state rules and provide a detailed explanation of the factors.
Review state rules for criteria for specific occupations subject to their own test.
Use written contracts with independent contractors.
Do not control, in contract or in fact, the details of an independent contractor’s work, keep the focus on the end result.
Clearly define the scope of services and the payment.
Avoid classifying workers as independent contractors if they perform the same work as employees or work integral to your business.
Ensure compliance with your state’s tax laws.
